1. About these terms
defenceukraine.com is operated by Defence Ukraine OÜ, an Estonian private limited company with registry code 17265004 and registered seat at Veski tn 69, 50409 Tartu, Estonia ("we", "us", "Defence Ukraine"). Full company information is published on our Imprint page.
These terms apply to anyone who visits the site or submits a form on it. By using the site you confirm that you accept them. If you do not accept them, do not use the site.
Your use of any personal information you provide to us is also governed by our Privacy Policy, which forms part of these terms.
2. What the site is
defenceukraine.com is an information site for European defence and dual-use companies, partner organisations, and other parties interested in the Ukrainian defence ecosystem. Through the site we publish information about:
- Defence Ukraine's programs (Tech Pilot, Market Access, Funding Access)
- Partnerships with other organisations (such as Fundwiser)
- Events we participate in or organise
- Editorial analysis and commentary
The forms on the site allow you to subscribe to our newsletter, contact us with a question, ask to be introduced to a partner, or express interest in an event.
The site does not sell goods or services online, does not process payments, and does not require you to register for an account. Any commercial relationship between you and Defence Ukraine arises from a separate agreement reached after off-site discussion, not from your use of this site.
3. Information on the site
We try to keep the content on defenceukraine.com accurate and up to date, but the site is for general information and we make no warranties about completeness, accuracy, timeliness, or fitness for any particular purpose. The information published here:
- does not constitute legal, financial, investment, tax, or other professional advice;
- does not create any contractual or fiduciary relationship between you and Defence Ukraine; and
- should not be relied upon as the sole basis for any decision.
You should obtain independent professional advice before taking any action on the basis of information on the site.
4. Using the forms
When you submit a form on the site, the information you provide is sent to us by email and processed in line with our Privacy Policy. Submitting a form:
- does not create a contract between you and Defence Ukraine;
- does not commit either of us to provide any service or product;
- does not create any obligation on us to respond, although we will make a reasonable effort to do so.
Any commercial arrangement that follows a form submission will be governed by a separate written agreement, not by these terms.
By submitting a form you confirm that the information you provide is accurate, that you have the right to provide it, and that any third-party information you include (such as a colleague's email address) has been provided with that person's knowledge and permission.
5. Acceptable use
You agree not to:
- use the site or any form on it in a way that is unlawful, fraudulent, defamatory, harassing, or harmful;
- impersonate any other person or organisation, or misrepresent your affiliation;
- submit malicious code, automated spam, scraping requests at an unreasonable rate, or anything intended to interfere with the site's normal operation;
- attempt to gain unauthorised access to any part of the site, the underlying infrastructure, or any system connected to it;
- use the site in a way that violates applicable export controls, sanctions, or trade restrictions; or
- copy, reproduce, or republish substantial portions of the content for commercial purposes without our prior written permission.
We may suspend, restrict, or block access from any visitor we reasonably suspect of breaching these rules.
6. Intellectual property
All content on defenceukraine.com — including text, layout, graphics, the Defence Ukraine name and logo, the geometric tile artwork, and any other visual or written material — is © Defence Ukraine OÜ, except where another author or photographer is credited on our Credits page.
You may view, share, and quote from the site for personal, non-commercial purposes with appropriate attribution. Any other reproduction, redistribution, modification, or commercial use requires our prior written permission.
Where we use third-party material on the site, that material remains the property of its original author and is used under the licence stated on the Credits page. If you are the rights holder for any material on the site and believe it has been used without proper attribution, please contact us at [email protected].
7. Third-party links and content
The site contains links to websites operated by third parties (for example, partner organisations, external sources cited in editorial pieces, or service provider sites). We do not control those websites and are not responsible for their content, accuracy, privacy practices, or availability. A link from defenceukraine.com to another website does not imply that we endorse the operator of that website or anything published on it.
8. Disclaimer of warranties
The site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation.
We do not warrant that the site will be free of errors, viruses, or other harmful components, that defects will be corrected, or that the site or the server that makes it available are free of harmful elements.
9. Limitation of liability
To the maximum extent permitted by law, Defence Ukraine OÜ, its board members, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunities, or goodwill, arising from your use of or inability to use the site or any reliance on information published on it, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded under applicable law, our total liability to you for all claims arising from or relating to the site is limited to the greater of (a) one hundred euros (€100) or (b) the amount you have paid us in the twelve months preceding the event giving rise to the claim. Since the site does not charge for access, this amount is typically zero.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify Defence Ukraine OÜ against any third-party claims arising from your breach of these terms, your misuse of the site, or any content you submit through a form on the site that infringes another party's rights.
11. Changes to the site and to these terms
We may change, add, remove, or temporarily or permanently discontinue any part of the site at any time without notice. We may also update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced on the site itself. Your continued use of the site after a change indicates that you accept the updated terms.
12. Governing law and jurisdiction
These terms are governed by the law of the Republic of Estonia, without regard to its conflict-of-laws rules. Any dispute arising from or relating to these terms or your use of the site that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Estonian courts.
If you are a consumer based in another EU member state, the protection of mandatory consumer-protection rules in your country of residence is not affected by this clause.
13. Severability
If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be replaced by a valid provision that most closely matches its original intent.
14. Contact
For any question about these terms, contact [email protected] or write to us at the registered address published on our Imprint page.
